As I was driving down the road recently, a woman making a three-point turn backed into my vehicle. Her car was almost perpendicular, blocking the road except for the right lane. I tried to pass in that lane, and she hit me. The collision damaged my car significantly but caused little damage to her SUV. I took down the woman’s license plate, driver’s license number, and insurance info, but I did not file a police report. Now the other driver is trying to change her story, saying that she was pulling out with the front of her car toward the street and that I tried to squeeze by, hitting her. I have contacted my insurance about this matter, but they tell me there is nothing they can do because I failed to file a police report. Is there anything I can do?

Answer

The best thing you can do for an issue of this magnitude is contact your local police. Explain what happened, show pictures of the damage to your car if you can, and tell them about the other driver’s false account. You may also want to talk to an accident attorney. This will give you more clout in dealing with the other driver, and the attorney can get in touch with accident reconstruction and traffic accident investigation specialists to make your case. These professionals specialize in analyzing evidence to determine what happened and who was at fault in collisions.
